Will a previously failed drug screening stay on my file?
This morning I passed a pre-employment drug screening with an executive placement agency. However, I had failed that test back in 2010 with that very same executive placement agency, but for a different client of the agency. What I would like to calm my fears over is whether the temp agency hold that failed drug screening against me or just rely on the new drug screening that I successfully passed?
By the way, I did pass the criminal background check with flying colors twice already.

You know, I would hate to steer you in the wrong direction by giving you wrong advice. I’m not sure how this issue is looked upon by an employment agency. So I will play the “devil’s advocate” on this one.
Why? — Because they may feel liable of the fact that they are “in-the-know” for your previously tested positive drug screening, which is the reason you were not placed with their client previously. Let’s say you had a substance abuse problem and although you tested clean today, you relapse three months from now. Hungry for money, you embezzle from this client, their client files lawsuit against the temp agency based on the fact that they knew about your drug problem and therefore were negligent on their selection decision which is what the reason they were originally contracted.
If you are clean now, why not just apply at a different placement agency? – I’m pretty positive that this executive placement agency cannot share their drug screening results with none other than their own clients as it is not a matter of public records.
Once again I’m compelled to repeat that my opinion is NOT considered legal advice, but merely just common sense.
